Position Overview
The Head of Commercial Contracts will be responsible for leading and facilitating contract negotiation with key, strategic clients, ensuring that these agreements align with the company objectives, mitigate risk, and support long-term business relationships. This role requires strong commercial awareness, interpersonal skills to balance client satisfaction with organizational interests, and effective cross-departmental collaboration skills, working closely with the Datwyler legal department, as well as the individual Global Key Account Managers. This role will also be required to propose, fine-tune, and implement a formal process for contract negotiation, considering the Datwyler Delegation of Authorities.
Key Responsibilities
- Lead and manage end-to-end contract negotiations with key clients, focusing primarily on pharmaceutical global innovators
- Draft, review, and revise complex commercial agreements, in partnership with Datwyler Legal, including master supply agreements, development contracts, complex C/NDAs, and licensing or partnership contracts.
- Collaborate with internal stakeholders (legal, sales, finance, procurement, operations, technical services, engineering, quality, executive management, …etc.) to ensure alignment on contract terms, risk tolerance, and strategy/business objectives.
- Identify potential legal and commercial risks in proposed contracts and recommend practical mitigation strategies.
- Maintain a deep understanding of Datwyler company policies, market standards, and regulatory requirements impacting contracts.
- Facilitate smooth communication between external parties and internal decision makers to achieve timely contract closure.
- Track and manage contract negotiation timelines, approvals, and documentation in accordance with Datwyler company processes (to be defined by the role).
- Provide training and guidance to business teams on contract terms, negotiation strategies, and best practices.
- Continuously improve contract templates, playbooks, and negotiation workflows for efficiency and consistency.
Experience
- Bachelor’s degree in business, science, or related field
- 10+ years of experience in sales and contract negotiation
- Proven success negotiating complex agreements with large/strategic pharmaceutical partners
- Experience working in pharmaceutical injectable packaging, drug delivery, devices/systems, is a plus.
Skills
- Strong negotiation, communication, and relationship management skills
- Excellent organization, structure, and attention to detail, with the ability to simultaneously manage multiple negotiations
- Sound judgement with the ability to balance legal risk and business opportunity
- Proficiency with contract management and related systems (MS Teams, Word, Excel, Outlook)
